S. 3236 — Increasing Tribal Input on Nutrition Act of 2025

This section amends the Food Distribution Program on Indian Reservations (FDPIR)—which provides USDA commodities to low-income households on Indian reservations as an alternative to the Supplemental Nutrition Assistance Program (SNAP)—to (1) capitalize "Tribal organization" throughout subsection (b), (2) require consultation with Indian Tribes and Tribal organizations prior to evaluating contracts, with their feedback integrated and considered throughout the process, and (3) establish procedures for supply chain disruptions (i.e., food shortages impeding commodity distribution, including those from warehouse issues affecting contracting, production, sourcing, procurement, transportation, or storage), requiring the Secretary of Agriculture, upon determination, to designate an emergency warehouse contractor within 45 days and authorize direct payments or reimbursements to administering Tribes or Tribal organizations for food purchases not exceeding otherwise planned expenditures, subject to conditions on domestically produced commodities of similar or higher nutritional value that supplant (not supplement) existing packages (waivable by the Secretary), with notification to affected parties and public posting. This section further amends the Commodity Supplemental Food Program (CSFP)—which provides monthly food packages to low-income individuals age 60 and older—to require annual consultations with Indian Tribes and Tribal organizations, encourage State agencies to consult with them prior to submitting State plan amendments (with documentation) and provide technical assistance on conducting such consultations, and establish procedures for supply chain disruptions (defined similarly) requiring designation of an emergency warehouse contractor within 45 days of determination, with notification to affected parties and public posting.
