S. 3238 — Conscience Protections for Medical Residents Act

This section excludes from the definition of an approved residency training program under Medicare graduate medical education payments—effective on the date of enactment of the Conscience Protections for Medical Residents Act—any program that (1) provides or requires training in performing or assisting with induced abortions or in counseling or referrals for such abortions without participants' voluntary opt-in election, or (2) discriminates against participants who do not opt in or who decline to perform, assist with, counsel, or refer for such abortions. (Medicare provides direct graduate medical education payments to teaching hospitals for the costs of approved residency slots and indirect medical education adjustments to inpatient prospective payment rates to account for higher costs of treating sicker patients.)
