S. 3259 — RECAPTURE Act

This section modifies the Broadband Equity, Access, and Deployment (BEAD) Program—under which the Assistant Secretary of Commerce for Communications and Information allocates grants to states and territories to deploy broadband infrastructure to unserved and underserved locations—such that, upon an eligible entity's failure to meet certain subgrant disbursement requirements in specified challenge processes, only the portions of remaining allocated funds designated for specific purposes in the entity's final proposal must be made available to the entity, with undesignated portions deposited in the general fund of the Treasury for deficit reduction. (Thus, previously available remainder funds are partially redirected from reuse by the entity to federal deficit reduction.) It also makes technical and conforming amendments to the reallocation provision in subsection (c)(5)(C)—including striking one clause and redesignating subclauses—and changes "approvals" to "approves" in subsection (e)(4)(A)(i).
