This section removes the prohibition on the Inspector General of the Department of Justice (DOJ OIG) investigating DOJ attorneys with respect to their exercise of authority to conduct criminal investigations, develop evidence for grand jury or court proceedings, make decisions or recommendations on whether to proceed with criminal investigations or prosecutions, or otherwise perform official duties as attorneys representing the United States (previously at subsection (b)(3)). (Thus, the DOJ OIG's general authority under subsection (b)(2) to investigate DOJ personnel—except as limited by national security exceptions in subsection (a)—now fully applies to DOJ attorneys.) The section also (1) strikes the cross-reference to subsection (b)(3) in subsection (b)(2); (2) redesignates subsections (b)(4) and (b)(5) as (b)(3) and (b)(4), respectively, with a conforming change; and (3) eliminates the exception for allegations described in former subsection (b)(3) from the referral requirements in subsection (d).
