S. 3322 — Upholding Protections for Unaccompanied Children Act of 2025

This section exempts individuals who are, or were previously determined to be, unaccompanied alien children (UACs)—minors in federal custody due to immigration status and lacking a parent or guardian, per 6 U.S.C. 279(g)(2)—from multiple fees established by Public Law 119-21, as follows: (1) asylum application fee; (2) employment authorization document fee; (3) annual asylum fee; (4) employment authorization renewal fees for parolees, asylum applicants, and temporary protected status recipients; (5) immigration court fees; (6) in absentia removal fee; and (7) border apprehension fee. It also repeals the special immigrant juvenile (SIJ) fee under Section 100005 of P.L. 119-21 and clarifies that the Secretary of Homeland Security may not impose any fee on aliens, parents, or legal guardians applying for SIJ status.

This section limits body examinations by striking (1) paragraph (3) of Section 87001(b) of Public Law 119–21, governing examinations conducted by the Office of Refugee Resettlement; and (2) paragraph (11) of Section 100051 of Public Law 119–21, governing examinations conducted by the Department of Homeland Security.

This section prohibits the Secretary of Health and Human Services from sharing sponsor information obtained under section 87001 of Public Law 119-21 with the Department of Homeland Security or any other federal agency for immigration enforcement purposes (as defined in section 101(a)(17) of the Immigration and Nationality Act).

This section requires the Secretary of Homeland Security or the Attorney General to refund, not later than 180 days after enactment, each fee paid by or on behalf of any individual under a provision of law repealed or amended by this Act to exempt such individual from payment.
