S. 3347 — Flight Delay and Cancellation Compensation Act

This section establishes an Aviation Rulemaking Committee, to be convened by the FAA Administrator not later than 90 days after enactment, to develop recommendations on implementing passenger compensation requirements under section 512 of the FAA Reauthorization Act of 2024 (as amended by subsection (e)) and ensuring air carriers and foreign air carriers provide cash compensation of at least $300 (for delays of more than 3 but less than 6 hours) or $600 (for delays of 6 hours or more), plus free rebooking, when cancellations or significant delays are attributable to the carrier. The committee—comprising air carriers, foreign air carriers, airport operators, consumer representatives, Department of Transportation (DOT) officials, and Federal Trade Commission representatives—must submit a report to the FAA Administrator and DOT Secretary within 12 months containing consensus recommendations on comparable compensation standards (e.g., Canadian and EU models), amenities coverage (e.g., meals, lodging, transportation), carrier attribution processes, passenger education, streamlined claims, baggage damage compensation under the Montreal Convention, and related matters. This section further directs the DOT Secretary, not later than 90 days after receiving the committee report, to issue a notice of proposed rulemaking incorporating the committee's recommendations, section 512 (as amended), and carrier-attributable compensation and rebooking requirements. Additionally, not later than 18 months after enactment, the Secretary must promulgate an interim final rule—effective until the final rule's effective date—requiring air carriers and foreign air carriers, for carrier-attributable cancellations or significant delays, to provide: (1) $750 cash compensation per affected passenger; (2) free rebooking on another flight or alternative transportation; (3) a meal or meal credit; and (4) for overnight disruptions, all of the above plus complimentary hotel accommodations (or reimbursement) and ground transportation to and from the hotel.
