S. 3354 — QUIET Act

This section establishes a disclosure requirement, in new subsection (k) of the Telephone Consumer Protection Act (47 U.S.C. 227), for robocalls using artificial intelligence to emulate a human being, mandating that the fact of such use be disclosed at the beginning of the call or text message. It defines robocall as a call or text message using an automatic telephone dialing system to stored or randomly/sequentially generated numbers, or using an artificial or prerecorded voice or artificially generated message (excluding those requiring substantial human intervention), and defines text message to include SMS, MMS, and RCS messages transmitted via 10-digit numbers, short codes, N11 codes, email addresses, or app-to-person messaging (excluding real-time voice or video).

This section establishes enhanced penalties under the Telephone Consumer Protection Act (TCPA; 47 U.S.C. 227) for violations involving the use of artificial intelligence to impersonate an individual or entity in a call or text message with intent to defraud, cause harm, or wrongfully obtain anything of value. It doubles (1) the maximum forfeiture penalties under TCPA subsections (b)(4) or (e)(5)(A) or 47 U.S.C. 503(b); and (2) the maximum criminal fines under TCPA subsection (e)(5)(B) or 47 U.S.C. 501. The enhanced penalties apply to violations occurring after the date of enactment.
