S. 3416 — Safeguarding U.S. Rulemaking Act

This section limits public participation in federal agency notice-and-comment rulemaking and petition processes under the Administrative Procedure Act (5 U.S.C. 553) by—(1) excepting requirements in subsections (c) (opportunity for written comments) and (e) (right to petition for rule issuance, amendment, or repeal) as provided in new subsection (f); and (2) adding subsection (f) to deem ineligible a foreign government designated by the Secretary of Commerce as a foreign adversary under 15 CFR 791.4(a), or any national of or entity incorporated in such government. (Thus, these parties may not submit comments on proposed rules or petition agencies.)
