This section establishes new authority under 32 U.S.C. §328a for a state's chief executive, after declaring a disaster emergency and with the Secretary of Defense's consent, to order National Guard members performing Active Guard and Reserve (AGR) duty—full-time positions supporting reserve component administration, recruiting, instruction, and training—to perform reimbursable "state disaster response duty" in response to or preparation for the disaster, provided it does not interfere with their primary AGR duties. Such duty is limited to 14 days per member per calendar year, extendable by the Secretary upon request by up to 7 days or 46 days if supporting a catastrophic incident (as defined in 6 U.S.C. §311, i.e., a natural disaster, terrorism, or man-made disaster causing extraordinary casualties or disruption); requires states to reimburse the military department for fully burdened manpower costs using non-federal funds (with duty suspension after 90 days of arrears unless authorized and funded); and provides that performing members are not U.S. instrumentalities, with the United States not liable for related claims. The section further requires the Secretary of Defense to prescribe implementing regulations within 180 days of enactment.
