S. 3458 — Background Check Completion Act of 2025

This section revises the timeframe for national instant criminal background check system (NICS) responses prior to firearm transfers by licensed dealers under 18 U.S.C. 922(t)(1) to restore the default proceed rule after 3 business days if no prohibition is communicated (from current law prohibiting transfers until completion, up to 10 business days). It also makes technical and conforming amendments by (1) revising the delayed repeal provision in sec. 12001(a)(3) of the Bipartisan Safer Communities Act to repeal only the addition of former subparagraph (C); and (2) striking the 10-business-day maximum from 34 U.S.C. 40901(l)(3).
