S. 3493 — Carson City Public Land Correction Act

This section defines terms for purposes of the Act: (1) Account, meaning the Carson City Special Account established under section 2601(e)(1)(B) of the Omnibus Public Land Management Act of 2009 (Public Law 111-11); (2) City, meaning Carson City, Nevada; (3) Map, meaning the map entitled “Carson City OPLMA Lands 2025” and dated December 11, 2025; and (4) Secretary, meaning the Secretary of Agriculture with respect to National Forest System land and the Secretary of the Interior with respect to other federal land.

This section directs the Secretary of the Interior, notwithstanding land use planning and public lands disposal identification requirements under sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1712, 1713), to convey to Carson City, Nevada, at the city's request and for no consideration, approximately 1,288 acres of identified federal land in Nevada, subject to valid existing rights. The city must use the land for public purposes allowed under the Recreation and Public Purposes Act (43 U.S.C. 869 et seq.)—including recreation and flood mitigation—pay all related costs (e.g., surveys, appraisals, environmental compliance, and administrative fees), and hold the land subject to reversion to the United States, at the Secretary's discretion, if those uses cease.

This section directs the Secretary of the Interior or Agriculture, at the request of the City of Carson City, Nevada, to convey to the city, subject to valid existing rights and for no consideration, approximately 0.45 acres of federal land depicted as “Lands to acquire” on the map for roadway expansion, with the city paying all related costs (including surveys, appraisals, environmental response, restoration, and administrative costs). The city must construct, in consultation with the Secretary and not later than 90 days after conveyance, a crosswalk across South Curry Street to maintain access to the Carson Ranger District Office of the Forest Service. For this conveyance, the Secretary must comply with hazardous substance disclosure requirements under section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA; 42 U.S.C. 9620(h)) but is not required to remediate or abate hazardous substances, pollutants, contaminants, solid or hazardous waste, or remove improvements; the exact acreage and legal description are to be determined by survey, with maps and descriptions to be finalized, made publicly available, and subject to minor corrections by mutual agreement.

This section directs the Secretary of the Interior to conduct one or more sales of approximately 360 acres of specified Bureau of Land Management (BLM)-managed public land to qualified bidders, subject to valid existing rights and notwithstanding the land use planning and sales provisions of the Federal Land Policy and Management Act of 1976 (FLPMA). (Thus, the sales bypass FLPMA's requirements for land use plans and discretionary disposals.) Any related costs, including surveys and administration, are to be paid by the buyer; upon disposal, the City retains (1) a public utility easement along Koontz Lane and Conti Drive for waterlines and access to a water tank and trailhead and (2) a drainage easement for a future detention basin on APN 010-152-06.

This section requires the Secretary of the Interior to accept, within one year of offer, conveyance from the City of approximately 20 acres of land depicted as “Lands to Dispose” on the Map. The Secretary must then dispose of the land through one or more sales to qualified bidders, notwithstanding land use planning (43 U.S.C. 1712) and management decision requirements (43 U.S.C. 1713) of the Federal Land Policy and Management Act of 1976. (Thus, the disposal bypasses normal Bureau of Land Management public involvement processes.) The City pays all conveyance costs; the buyer pays disposal costs; the City retains a public utility easement and right-of-way; and responsible parties pay hazardous substance remediation costs.

This section requires deposit of proceeds from federal land sales under sections 3 through 6, in addition to amounts already deposited under section 2601(e)(1)(B) of the Omnibus Public Land Management Act of 2009 (Public Law 111-11), into the Account. Those amounts are available to the Secretary of the Interior without further appropriation or fiscal year limitation for (1) reimbursing the Secretary's preparation costs for the sales, including surveys, appraisals, and compliance with NEPA and FLPMA sections 202 and 203 (43 U.S.C. 1712, 1713); (2) reimbursing the City for its preparation costs; (3) wildlife habitat conservation and restoration projects, including for greater sage-grouse; (4) hazardous fuels reduction, wildfire prevention, and restoration projects; (5) acquiring environmentally sensitive land or interests in the City; (6) wilderness protection activities; (7) BLM and Forest Service capital improvements in the City; and (8) the City's educational purposes. The section further provides for investment of Account funds at market yield rates determined by the Treasury Secretary and management of the Account via an intergovernmental agreement between the City and BLM.

This section amends the Omnibus Public Land Management Act of 2009 concerning public land management in Carson City, Nevada, as follows: (1) authorizes the city to sell, lease, or otherwise convey land described in section 2601(b)(2)(B)(iv) to third parties for economic development, recreation, or other public purposes at not less than fair market value; and (2) requires the Secretary of the Interior to offer land described in section 2601(d)(2)(A) and (B) for sale to a qualified bidder not later than one year after enactment of the Carson City Public Land Correction Act.
