S. 3522 — No Red Tape For Addiction Treatment Act

This section requires state Medicaid plans (or waivers) to cover at least one formulation of each FDA-approved drug or biological product for medication-assisted treatment (MAT) of opioid use disorder—including a long-acting injectable formulation if available—without prior authorization or dosage limitations as a condition of coverage or payment, effective for medical assistance provided one year after enactment (with an exception delaying enforcement until the first calendar quarter after the first regular legislative session for states requiring legislation). It makes a conforming amendment to preserve states' authority (except as provided under this requirement) to exclude or restrict coverage of certain drugs under Medicaid drug rebate rules.

This section directs the Medicaid and CHIP Payment and Access Commission (MACPAC) to submit to Congress, not later than one year after enactment, a report on utilization management controls for medication-assisted treatment of opioid use disorder under Medicaid. The report must include (1) an analysis of such controls across all states—including dosing restrictions, age limits, counseling requirements, and psychological screening requirements; (2) an assessment of the administrative burden on clinicians and providers; and (3) an assessment of other federal and state Medicaid policies impeding patient access to medication-assisted treatment or complicating prescribing practices.
