S. 354 — SHOW UP Act of 2025

This section establishes definitions for terms used in the Act: (1) "agency," having the meaning of "Executive agency" in 5 U.S.C. §105 (i.e., an Executive department, a Government corporation, or an independent establishment); (2) "Director," meaning the Director of the Office of Personnel Management; (3) "locality pay," meaning locality pay provided under 5 U.S.C. §5304 or §5304a; and (4) "telework" and "teleworking," having the meaning given those terms in 5 U.S.C. §6501 and including remote work.

This section requires the head of each executive agency to reinstate and apply the agency's telework policies, practices, and levels in effect on December 31, 2019, not later than 30 days after enactment. The section prohibits any expansion of such policies, practices, or levels until the agency head submits to Congress (1) an agency plan under section 4(a)(2) and (2) a certification under section 4(a)(3).

This section requires the head of each executive agency, in consultation with the Director of the Office of Management and Budget, to submit to Congress, not later than 180 days after enactment, (1) a study analyzing specified impacts on the agency and its mission from the expansion of telework during the COVID-19 public health emergency declared under section 319 of the Public Health Service Act (42 U.S.C. 247d) on January 31, 2020—including adverse effects on mission performance and customer service, costs from underutilized real property or improper locality pay, deficiencies in secure telework tools and equipment, workforce dispersal, and other relevant impacts; (2) any agency plan to expand telework policies, practices, or levels beyond those in effect on December 31, 2019; and (3) a certification by the Director that the plan will substantially improve mission performance and customer service, increase workforce dispersal, reverse study-identified adverse impacts, reduce real property and locality pay costs, and ensure secure and productive telework without substantially raising related costs. This section further prohibits agencies from implementing any such plan without the required certification and authorizes resubmission of revised plans until certified.
