S. 3543 — Trade Cheating Restitution Act of 2025

This section modifies the interest eligible for distribution under section 605(c)(1) of the Trade Facilitation and Trade Enforcement Act of 2015 (19 U.S.C. 4401(c)(1))—which covers interest accrued on antidumping and countervailing duties held by U.S. Customs and Border Protection (CBP) in connection with distributions under the repealed Continued Dumping and Subsidy Offset Act of 2000 (CDSOA; 19 U.S.C. 1675c, repealed 2006; i.e., duties assessed before repeal and distributed to affected U.S. producers)—by striking subparagraphs (A) and (B) and changing the relevant date to October 1, 2000 (from October 1, 2014). It directs CBP to fund implementation using the Department of the Treasury's "Refund of Moneys Erroneously Received and Covered" account and to conduct a special pro rata distribution, by antidumping or countervailing duty order or finding, of all such interest realized for fiscal years ending before enactment to eligible prior CDSOA recipients who certify and meet CDSOA eligibility criteria: (1) interest realized on or after October 1, 2010, as soon as possible but not later than 210 days after enactment; and (2) interest realized on or after October 1, 2000, and before October 1, 2010, as soon as possible but not later than 210 days after the distribution under (1). (Thus, the amendments expand the interest pool for future annual distributions and provide a one-time payout of pre-enactment interest to CDSOA recipients.)
