This section establishes a new criminal offense under 18 U.S.C. §1390 prohibiting any person from knowingly entering or remaining within a posted protective zone around a National Guard member—defined as an area with a perimeter not more than 15 feet marked by verbal warning, visible signage, barricade tape, or other reasonable means—with intent to impede, intimidate, or interfere with the member's official duties during deployments authorized under 10 U.S.C. chapter 15 or 32 U.S.C. Violators are subject to a fine, imprisonment for not more than 1 year, or both; the maximum term increases to 5 years if the violation involves physical contact with, throwing an object at, or spitting on the member. The section states that it does not prohibit First Amendment-protected activity conducted outside a posted protective zone and includes a conforming amendment to the table of sections for 18 U.S.C. chapter 67.
