S. 3567 — Cartel Marque and Reprisal Authorization Act of 2025

This section declares congressional findings that (1) Article I, Section 8 of the Constitution grants Congress authority to issue letters of marque and reprisal against cartel aggressors, and (2) cartels pose an unusual and extraordinary threat to U.S. national security and foreign policy.

This section authorizes the President to commission, through letters of marque and reprisal (i.e., licenses for privateers to capture enemy vessels, personnel, and property), privately armed and equipped persons and entities to seize outside the United States and its territories the person and property of individuals determined by the President to be members of a cartel, cartel-linked organization, or conspirators responsible for acts of aggression against the United States. The section requires a security bond prior to issuance and defines "cartel" to include organizations designated as foreign terrorist organizations or specially designated global terrorists in the Executive Order titled “Designating Cartels And Other Organizations As Foreign Terrorist Organizations and Specially Designated Global Terrorists” and dated January 20, 2025, or transnational criminal organizations as defined in 21 U.S.C. 2341(5).
