S. 3592 — PROTECT Military Families Act

This section amends the parole authority under INA sec. 212(d)(5)—which allows the Secretary of Homeland Security to temporarily parole inadmissible aliens into the United States for urgent humanitarian reasons or significant public benefit—by (1) revising subparagraph (A) to extend applicable exceptions to the new subparagraph (C), and (2) adding subparagraph (C) to require the Secretary to parole, in 1-year increments, any spouse, widow or widower, parent, or child of an active-duty Armed Forces member, Selected Reserve member, or individual (living or deceased) previously serving in such capacity who was discharged or released under conditions other than dishonorable. Parole under this provision may be denied only upon joint written justification by the Secretaries of Homeland Security, Defense, and Veterans Affairs (non-delegable), and the Department of Homeland Security must publish details of any such denial on its public website (excluding personally identifiable information).
