S. 36 — Protect Our Seniors Act

This section establishes a point of order in the Senate against considering any bill, resolution, amendment, motion, or conference report that reduces benefits under the Medicare program (title XVIII of the Social Security Act) or under title II of that Act (old-age, survivors, and disability insurance benefits). The point of order may be waived or suspended only by an affirmative two-thirds vote of Senators duly chosen and sworn.

This section establishes a point of order in the Senate against considering any bill, resolution, amendment, motion, or conference report whose total budgetary effects, as determined by the Congressional Budget Office, use decreases in outlays or increases in revenues under Medicare (i.e., health insurance programs under title XVIII of the Social Security Act) to offset costs of provisions not directly related to those programs. (Thus, Medicare savings cannot fund unrelated spending absent a waiver or successful appeal of the chair's ruling, each requiring an affirmative two-thirds vote of Senators, duly chosen and sworn.)
