S. 3614 — Internet Application I.D. Act

This section requires, beginning one year after the date of enactment, any person who owns, controls, or distributes access to a covered service to clearly and conspicuously disclose to any U.S.-resident individual who downloads or otherwise uses the service the following: (1) whether the service is owned wholly or partially by a foreign adversary country (e.g., China, Russia, Iran, or North Korea), by a foreign adversary country-owned entity, or by a non-state-owned entity located in such a country (i.e., an entity controlled by a governmental organization of such a country or organized under its laws); (2) whether information collected from the service is stored and maintained in a foreign adversary country; and (3) whether a foreign adversary country or country-owned entity has access to such information. A covered service is an internet website or mobile application meeting either criterion (1) or storing and maintaining such collected information in a foreign adversary country. The section makes it unlawful to knowingly disclose false information under these requirements.

This section deems violations of the Act to be violations of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)). It further directs the Federal Trade Commission to enforce the Act using the jurisdiction, powers, duties, penalties, privileges, and immunities of the Federal Trade Commission Act (15 U.S.C. 41 et seq.) and preserves the Commission's authority under other laws.
