S. 3618 — No Fentanyl on Social Media Act

This section requires the Federal Trade Commission (FTC), in coordination with the Secretary of Health and Human Services (through the Food and Drug Administration Commissioner) and the Drug Enforcement Administration Administrator, to submit to the House Committee on Energy and Commerce and the Senate Committee on Commerce, Science, and Transportation, and publicly release on the FTC website, a report within one year of enactment on minors' (i.e., under age 18) ability to access fentanyl—including analogues, fentanyl-related substances (as defined in 21 U.S.C. §812(c), schedule I(e)), and pressed pills—via social media platforms. The report must assess (1) the prevalence of such access by drug sellers; (2) health and physical safety risks to minors; (3) sellers' use of platforms to market, sell, deliver, distribute, dispense, or transact fentanyl; (4) platform design features affecting access; (5) platforms' practices, policies, and measures and their effectiveness; (6) actions by law enforcement, medical community, and others; and (7) recommendations for Congress. In developing the report, the FTC must consult stakeholders including parents, platforms, law enforcement, and medical professionals and, with Attorney General input, may redact law enforcement tactics from public release. The section defines social media platform as a public website, app, or mobile app (e.g., social networks, video sharing) primarily hosting user-generated content, excluding broadband providers and email.
