S. 3665 — Passenger Rail Crew Protection Act

This section establishes a federal criminal offense for any person onboard an operating passenger train (intercity or commuter rail), on a serving platform, or in a rail station to assault or intimidate a crew member (i.e., engineer, conductor, onboard personnel, safety-sensitive employee, or employee performing station operations or customer service) in a manner that interferes with the crew member's duties, or to attempt or conspire to do so. Penalties include a fine under title 18, imprisonment for up to 8 years, or both; the maximum increases to 20 years if a dangerous weapon (i.e., any device or substance capable of causing death or serious bodily injury, including a pocket knife with a blade less than 2.5 inches or a box cutter) is used.
