S. 3672 — NASA Talent Exchange Program Act

This section establishes a public-private talent program at NASA authorizing the Administrator to arrange temporary assignments of (1) NASA employees to private-sector entities or (2) private-sector employees to NASA, subject to the entity's agreement and employee's consent, for 90 days to two years (renewable for up to two additional years, or four years total if needed for critical mission requirements). Agreements must specify terms including, for NASA employees, a post-assignment service obligation equal to twice the assignment length, prohibitions on misusing predecisional information, and liability for assignment expenses if terms are breached (with waiver authority). NASA employees on such assignments are considered on detail within NASA, with Administrator certification of no adverse mission impact and no improper contractor augmentation of duties; private-sector employees to NASA retain private pay and benefits but are treated as federal employees for purposes including workers' compensation, ethics rules, tort claims, and procurement integrity (with restrictions on trade secrets, inherently governmental functions, and workforce circumvention), and the Administrator must implement conflict-of-interest mitigation.
