S. 3673 — Roadside Pollinator Program Amendments Act

This section revises the pollinator-friendly practices grant program under 23 U.S.C. 332 (i.e., grants to eligible entities for activities benefiting pollinators on roadsides and highway rights-of-way, such as planting native grasses and wildflowers, adjusted mowing, and integrated vegetation management) as follows: (1) expands eligible entities to include nonprofit organizations described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from tax under section 501(a), and specifies that Indian tribes must be included on the list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. 5131); (2) in the pollinator-friendly practices plan requirements, (A) requires consultation with the Director of the U.S. Fish and Wildlife Service prior to developing certain outreach or education programs, (B) applies certain plan development and tribal consultation requirements to State departments of transportation, Federal land management agencies, and nonprofits (previously limited to State departments of transportation and Federal land management agencies), (C) limits tribal consultation to tribes whose land is located 50 miles or less from proposed projects, and (D) clarifies that no additional consultation is required beyond plan development; (3) increases the minimum grant amount to $500,000 (from $150,000); and (4) increases annual funding to $5 million for each of FY2026 through 2031 (from $2 million for each of FY2022 through 2026).
