S. 3677 — Dietary Supplement Listing Act of 2026

This section establishes a dietary supplement listing requirement by adding a new section 403D to the Federal Food, Drug, and Cosmetic Act. Beginning 18 months after enactment, the manufacturer, packer, or distributor named on the label (responsible person) of each dietary supplement marketed in the United States—or its U.S. agent if foreign—must submit to the Secretary of Health and Human Services (HHS) specified information, including product name and identity, contact details, label copy, full ingredient list with amounts per serving (except proprietary blend amounts, which remain confidential), servings per container, directions for use, warnings, allergen statements, product form (e.g., tablets, gummies), and certain label claims. (1) Supplements marketed on or before January 1, 2027, must be listed within 18 months of enactment; (2) new supplements must be listed upon introduction into interstate commerce; (3) discontinuations must be reported within one year; and (4) changes to listings must be submitted to HHS, which provides confirmation of receipt and a product listing number. A single listing may cover multiple similar supplements differing only in color, excipients, flavorings, or package size.
