S. 3681 — Keep Our Border Agents Paid Act

This section establishes continuing appropriations, out of any money in the Treasury not otherwise appropriated, during a lapse in Department of Homeland Security appropriations to provide pay and specified benefits under 5 U.S.C. chapters 55 and 81 (i.e., pay and leave, injury compensation, and related expenses) to excepted employees (as defined in 31 U.S.C. 1341(c)(1)(D)) and covered contractors of five specified components: (1) Air and Marine Operations of U.S. Customs and Border Protection (CBP); (2) Office of Field Operations of CBP; (3) U.S. Border Patrol of CBP; (4) Homeland Security Investigations of U.S. Immigration and Customs Enforcement (ICE); and (5) Enforcement and Removal Operations of ICE. These appropriations terminate upon enactment of a regular appropriations act or continuing resolution providing funds for these purposes, with expenditures charged against such later appropriations; the section further authorizes use of these funds without regard to the apportionment submission and approval timelines in 31 U.S.C. 1513 (i.e., waiving requirements for executive agency heads to submit apportionment information to the President 40 days before a fiscal year or 15 days after enactment, and for presidential notification 20 days before or 30 days after). (Thus, enabling immediate pay and operations for these border security and enforcement personnel during a lapse.)
