§2. Removing certain age restrictions on Medicaid eligibility for working adults with disabilities
This section eliminates the upper age limit of less than 65 years old in two optional Medicaid eligibility groups for working individuals with disabilities—subclause (XV) of section 1902(a)(10)(A)(ii) (basic buy-in program) and subclause (XVI) (alternative buy-in program using different income/asset rules)—and requires states electing either group to cover, at minimum, individuals described in new section 1905(a)(xviii) and section 1905(a)(xii), respectively. (As background, Medicaid buy-in programs enable states to provide coverage to employed adults with disabilities by disregarding higher earnings and assets than standard Supplemental Security Income (SSI) limits.) It further (1) adds section 1905(a)(xviii) to define covered individuals as those age 16 or older who would qualify for SSI but for earnings exceeding the limit under section 1905(q)(2)(B); and (2) removes the less-than-65 age limit from the buy-in program's definition in section 1905(v)(1)(A). States providing such coverage as of enactment have until January 1, 2028, to comply.
