S. 3713 — No Climate Treaties Act of 2026

This section requires any agreement for U.S. entry or reentry into an international climate agreement, or mandating legally binding reductions in domestic greenhouse gas emissions—including the Paris Agreement—to be treated as a treaty requiring submission to the Senate for its advice and consent under Article II, Section 2, Clause 2 of the Constitution. (Thus, such agreements require a two-thirds Senate supermajority for ratification, rather than being entered as executive agreements.)

This section prohibits the obligation or expenditure of federal funds to implement, enforce, or otherwise comply with any international climate agreement mandating legally binding reductions in domestic greenhouse gas emissions unless the agreement has received Senate advice and consent as a treaty.
