S. 3721 — Empowering States' Rights To Protect Consumers Act of 2026

This section establishes limits on annual percentage rates (APRs) for consumer credit transactions (other than residential mortgages) by capping the applicable APR—including any associated fees—at the maximum rate permitted under the laws of the state where the consumer resides, notwithstanding any other provision of law. (Thus, federally permitted rates exceeding a consumer's state usury cap are preempted.)
