S. 3731 — Cost of Police Misconduct Act of 2026

This section establishes definitions related to law enforcement misconduct (e.g., allegation of misconduct, judgment, settlement) and reporting requirements for federal law enforcement agencies on judgments and settlements arising from such allegations. Specifically, it requires the Attorney General (AG), within 90 days of enactment and annually thereafter, to identify the total number and names of all federal law enforcement agencies and, within 120 days of enactment and annually thereafter, to publish that information on the Department of Justice website. Beginning 120 days after enactment, it requires each such agency to annually collect, for the prior year, (1) the total number of relevant judgments or settlements; (2) for each, details including demographics of involved parties, years of misconduct and allegation, allegation type (e.g., use of force, racial profiling, wrongful death), personnel actions, payment amounts and sources (including the Judgment Fund under 31 U.S.C. 1304), and injunctive relief; and (3) the agency's total payments; and to report that information to the AG within 60 days after year-end (extendable by the AG up to 60 days for good-faith efforts). (Thus, the requirements promote public transparency on federal law enforcement misconduct litigation outcomes and taxpayer-funded payouts.)
