S. 3752 — SAVE America Act

This section amends the National Voter Registration Act of 1993 (NVRA) to require documentary proof of U.S. citizenship for all voter registration applications in elections for federal office. It (1) defines "documentary proof of United States citizenship" to include a REAL ID indicating U.S. citizenship, valid U.S. passport, U.S. military ID with service record showing U.S. birth, government-issued photo ID showing U.S. birth, or other government photo ID presented with a certified birth certificate or equivalent document (e.g., U.S. hospital birth record, adoption decree showing U.S. birth, Consular Report of Birth Abroad, naturalization certificate, or American Indian Card with "KIC" classification); (2) prohibits states from accepting or processing any registration application without such proof; (3) applies the requirement to motor vehicle driver's license applications (subject to new procedures in section 8(j)), mandates citizenship verification, specifies documentary proof, and limits state use of applicant data except in criminal or immigration proceedings for false registration claims; and (4) applies the requirement to the national mail voter registration form (subject to section 8(j)), updates references to the Election Assistance Commission, and directs chief state election officials to inform residents of the proof requirement. (Thus, states must reject federal voter registration applications lacking qualifying proof, supplementing prior attestation under penalty of perjury.)

This section requires each individual voting in an election for Federal office to present an eligible photo identification document, striking and replacing prior requirements in section 303(b) of the Help America Vote Act of 2002 (52 U.S.C. 21083(b)) preceding paragraph (4) related to provisional ballots for voters without acceptable identification. For in-person voting, the document must be tangible and presented at the polling place; for absentee voting, a copy must accompany both the ballot request and submission. An eligible photo identification document must (1) be issued by specified authorities (i.e., state motor vehicle agency, state or local election office, Native tribal government, Department of State, Department of War, or Armed Forces branch); (2) include the individual's photograph, an indication of U.S. citizenship on the front, and either a driver's license number or the individual's last four digits of the Social Security number; and (3) if lacking a citizenship indication, be accompanied by another document verifying citizenship. States using the Systematic Alien Verification for Entitlements (SAVE) program quarterly since June 1, 2025, to verify voter rolls are exempt from the citizenship indication requirement for pre-existing registrants, provided they indicate citizenship verification status and dates in voter records. The requirements apply to all Federal elections on or after the date of enactment.
