This section amends the Federal Food, Drug, and Cosmetic Act (FD&C Act) by— (1) prohibiting the introduction or delivery for introduction into interstate commerce of (A) any product marketed as a dietary supplement (defined in FD&C Act section 201(ff) (21 U.S.C. 321(ff)) as a product, other than tobacco, intended to supplement the diet and containing ingredients such as vitamins, minerals, herbs, or amino acids) that does not meet that definition, and (B) any dietary supplement prepared, packed, or held using the assistance of, or at the direction of, a person debarred under FD&C Act section 306 (21 U.S.C. 335a) (i.e., mandatory or permissive debarment for persons convicted of certain felonies related to controlled substances or FD&C Act violations); (2) expanding import exclusions under FD&C Act section 801(a) (21 U.S.C. 381(a)) to include products violating these new prohibitions; and (3) expanding seizure authorities under FD&C Act section 304 (21 U.S.C. 334) to include such products.
