S. 3798 — Safe Access to Cash Act of 2026

This section establishes new federal criminal offenses in 18 U.S.C. § 2113A concerning ATM robbery and related crimes. It criminalizes (1) robbery or extortion by force, violence, or intimidation from persons using or servicing ATMs (including recent users), or from owners/operators or their agents transporting property for ATMs, punishable by fine or imprisonment up to 20 years, or both; (2) unauthorized breaking into, tampering with, damaging, removing, or stealing from an ATM—punishable by up to 10 years imprisonment if more than $1,000 is taken or attempted and up to 1 year if $1,000 or less; (3) receipt, possession, concealment, storage, barter, sale, or disposal of property stolen in violation of the above, punishable as the underlying offense; (4) forcible assault or endangering life with a dangerous weapon during such offenses, punishable by up to 25 years imprisonment; and (5) killing or forcible accompaniment of a person during commission, escape, or avoidance of apprehension or confinement for such offenses, punishable by a minimum of 10 years imprisonment or life if death results. The section defines "ATM" as any network-connected automated teller machine allowing account access via card or device (regardless of location or ownership) and incorporates definitions of "bank," "credit union," "savings and loan association," and "extortion" from existing law. Subsection (b) makes a conforming amendment to the table of sections for 18 U.S.C. ch. 103.

This section expands federal bank robbery offenses under 18 U.S.C. 2113(a) by (1) replacing “force and violence” with “force or violence”; and (2) adding conspiracy to the prohibited acts of taking or attempting to take property from the person or presence of another by force or violence or intimidation. (Thus, the changes broaden liability to include force alone without violence and explicit conspiracy to commit such a robbery.)
