S. 3803 — Right to Redress Act

This section amends the Federal Tort Claims Act (FTCA) as follows: (1) requires administrative exhaustion under section 2675(a) for claims against the United States seeking money damages for injury, property loss, personal injury, or death caused by negligent or wrongful acts or omissions of federal law enforcement officers acting within the scope of employment, and establishes a right to jury trial at the claimant's request under new section 2675(d); (2) excludes such acts or omissions from the FTCA's exclusive remedy provision under section 2676; and (3) eliminates the discretionary function exception under section 2680(a) for such claims, while cross-referencing the definition of federal law enforcement officer (i.e., any U.S. officer, agent, or employee authorized to engage in or supervise prevention, detection, investigation, or prosecution of federal civil or criminal law violations) in section 2675(e) and section 2680(h). (As background, the FTCA waives sovereign immunity for common-law tort claims against the United States but generally bars jury trials, deems FTCA judgments the exclusive remedy precluding constitutional tort suits such as Bivens actions, and exempts claims based on discretionary functions of government employees. Thus, these changes enable jury trials, alternative remedies, and liability for discretionary acts in law enforcement tort cases.) It makes a conforming amendment to 28 U.S.C. §2402 to authorize jury trials for such claims. The amendments apply to claims arising before, on, or after enactment but do not revive expired claims or reopen finally adjudicated claims.
