This section establishes a new criminal offense under section 1925 of title 18, United States Code, making it unlawful for any responsible executive official of a State or unit of local government, acting under color of law, to knowingly prohibit, limit, or restrict compliance with a formal Department of Homeland Security request for reasonable advance notice—at least 48 hours prior when practicable—of the release of a criminal alien. The section defines criminal alien to mean an alien charged with or convicted of any Federal or State crime, and it sets tiered penalties for violations: imprisonment for not less than 10 years and not more than 25 years if the released alien was charged with or convicted of murder, rape, or a Federal or State sex offense against a minor; not less than 5 years and not more than 10 years if charged with or convicted of a serious violent felony; and not less than 30 days and not more than 6 months for any other Federal or State offense. This section also includes a severability clause and makes a conforming amendment to the table of sections for chapter 93 of title 18.
