S. 3812 — WORK to Save Lives Act

This section directs the Secretary of Labor, acting through the Occupational Safety and Health Administration (OSHA), to issue non-mandatory guidance to employers on acquiring and maintaining opioid overdose reversal medication and annually training employees on its use, no later than 270 days after enactment. For this purpose, employer has the meaning given in section 3 of the Occupational Safety and Health Act of 1970 (29 U.S.C. 652)—generally, a person engaged in a business affecting commerce who has employees, excluding the United States (other than the United States Postal Service) and any state or political subdivision—except that it further excludes the United States Postal Service.

This section directs the Secretary of Labor, acting through the Occupational Safety and Health Administration, to issue regulations not later than 270 days after enactment requiring each federal agency—including the Veterans Health Administration notwithstanding its statutory exemption—to (1) acquire and maintain opioid overdose reversal medication and (2) train employees annually on its use.
