§301.Independent contractors, interns, fellows, volunteers, and trainees
This section extends all protections under Title VII of the Civil Rights Act of 1964, the Government Employee Rights Act of 1991, the Congressional Accountability Act of 1995, subchapter II of chapter 5 of title 3, United States Code, the Age Discrimination in Employment Act of 1967, title I and section 503 of the Americans with Disabilities Act of 1990, sections 501 and 505 of the Rehabilitation Act of 1973, section 6(d) of the Fair Labor Standards Act (Equal Pay Act), title II of the Genetic Information Nondiscrimination Act of 2008, and 38 U.S.C. 4311 to (1) independent contractors (regardless of business structure), interns, fellows, volunteers, and trainees engaged by covered employers or entities under those laws, whether compensated or not, and (2) applicants for such positions.
This section further extends protections under Title VII, the Age Discrimination in Employment Act, ADA title I, the Equal Pay Act, GINA title II, and 38 U.S.C. 4311—treated analogously to employment agencies under Title VII—to independent contractors, interns, fellows, volunteers, and trainees engaged by or applying to "covered establishments," defined as entities not otherwise covered by those laws but engaging such individuals via instruments of interstate commerce (i.e., transportation or communication among states).
This section deems households engaging persons in domestic service (as employees, independent contractors, interns, fellows, volunteers, or trainees) via interstate commerce instruments to be engaged in interstate commerce for purposes of the listed laws; includes a rule of construction preserving existing protections; and defines "interstate commerce" by reference to 29 U.S.C. 203(b). (Thus, these individuals gain the same anti-discrimination rights as employees, including against race, sex, age, disability, genetic, and other covered discrimination.)
