This section requires the Attorney General, not later than one year after enactment, to submit to the Senate and House Judiciary Committees a report listing all criminal statutory offenses (i.e., crimes under federal statutes), including for each offense: its elements, potential criminal penalties, Department of Justice prosecutions over the prior 15 years, and mens rea requirement. It further requires heads of 35 specified federal agencies—including the Departments of Agriculture, Commerce, Education, Energy, Health and Human Services, Homeland Security, Housing and Urban Development, the Interior, Labor, Transportation, and the Treasury; the Commodity Futures Trading Commission; the Consumer Product Safety Commission; the Equal Employment Opportunity Commission; the Environmental Protection Agency; and others—not later than one year after enactment, to submit similar reports to the Judiciary Committees on criminal regulatory offenses (i.e., federal regulations enforceable by criminal penalties) applicable to their agencies, including for each: potential penalties, referrals to the Department of Justice for prosecution over the prior 15 years, and mens rea requirement. Not later than two years after enactment, the Attorney General must establish a publicly accessible index of all criminal statutory offenses on the Department of Justice website, and each specified agency head must do the same for criminal regulatory offenses on the agency's website. (Thus, the indexes promote public transparency regarding the scope, penalties, and prosecutorial history of federal criminal offenses.) This section specifies that no appropriations are required or authorized.
