S. 3875 — Responsible Firearms Marketing Act

This section directs the Federal Trade Commission (FTC) to (1) conduct a study, using its authority under section 6(b) of the Federal Trade Commission Act (15 U.S.C. 46(b)) to require reports from businesses, on unfair or deceptive acts or practices in the advertising or marketing of firearms—considering materials appealing to individuals younger than 18 years of age, implying or encouraging illegal use, and relating to semiautomatic assault weapons—and submit a report with legislative or administrative recommendations to Congress within two years of enactment (exempting information collection from the Paperwork Reduction Act); and (2) promulgate regulations within 18 months after the report to prohibit manufacturers, dealers, and importers of firearms from engaging in such acts or practices. The section further provides that violations of the regulations are enforceable as unfair or deceptive acts under section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)), using the full powers, penalties, privileges, and immunities of that Act, and defines relevant terms (firearm, importer, manufacturer, dealer) by reference to 18 U.S.C. 921(a).
