S. 3884 — Small Business ICE Disruption Fund Act

This section defines terms for purposes of the Act, including (1) Administrator, as the Administrator of the Small Business Administration; (2) eligible entity, as a small business concern (as defined in 15 U.S.C. 632) located in an area with a federal immigration enforcement action within the past year that has experienced an immigration enforcement-related revenue loss of at least 25%, excluding concerns with more than 15 locations (including affiliates) or that are publicly traded; (3) Fund, as the Small Business ICE Disruption Fund established under section 3; (4) immigration enforcement-related revenue loss, as the difference between an eligible entity's gross receipts during the affected period and a comparable prior period (if positive), as verified by the Administrator; and (5) small business concern, as defined in 15 U.S.C. 632.

This section establishes the Small Business ICE Disruption Fund and appropriates $200 million for FY2026, to remain available until expended, for the Small Business Administration Administrator to award grants—on a first-come, first-served basis—to eligible entities certifying revenue losses from federal immigration enforcement actions for which they have received no other compensation. Grants equal verified losses but are capped at an aggregate of $1 million per entity and affiliates or $500,000 per physical location and require fraud checks, including business identifiers (e.g., EIN or SSN), tax return verification, and cross-checks against government databases.
