S. 3890 — National Council on African American History and Culture Act of 2026

This section establishes in the National Endowment for the Humanities a National Council on African American History and Culture composed of 12 members appointed by the President (with Senate confirmation) from private citizens with expertise in African American history and culture, including balanced political affiliation (6 Democrats, 6 Republicans), equitable representation of women, people of color, and individuals with disabilities, and staggered initial terms of 3 years for 6 members and 5 years for 6 members (with 5-year terms thereafter and no reappointment for 2 years post-term). The Council, which meets at least twice annually (with a quorum of 9 members required and no hearings permitted without a full quorum), must (1) submit annual reports to the NEH Chairperson on NEH efforts to preserve and celebrate African American history and culture; (2) gather and analyze information on related historical, cultural, and institutional developments to assess needs for national policy; (3) evaluate NEH programs and recommend changes to the President; (4) develop national policies to promote understanding, preservation, and celebration of African American contributions; and (5) provide studies and recommendations as requested by the NEH Chairperson. Council members receive compensation at 50% of the daily rate of the highest basic pay for senior-level positions above GS-15, plus travel expenses; the Council is exempt from Federal Advisory Committee Act termination requirements and terminates 10 years after enactment.
