S. 3908 — SOS: Sustaining Outpatient Services Act

This section modifies the definition of hospital outpatient department (OPD) services under the Medicare Part B OPD prospective payment system (PPS) by adding a new exclusion exception. Beginning in 2027, the definition includes items and services furnished by an off-campus OPD of a provider (i.e., generally excepted from the OPD PPS and paid under the physician fee schedule) if the greatest total amount paid under the physician fee schedule to any physician specialty for such items or services during the prior year was less than $2 million. (As background, the OPD PPS provides bundled prospective payments to hospitals for outpatient services; thus, this change allows OPD PPS payment for specified low-volume off-campus services.)
