S. 3917 — The Dalilah Law

This section amends 49 U.S.C. 31311(a)(12) to prohibit states from issuing or renewing commercial driver's licenses (CDLs), including non-domiciled CDLs, or other authorizations to operate commercial motor vehicles (CMVs) unless the individual is a U.S. citizen, lawful permanent resident, or nonimmigrant holding a valid, unexpired E-2, H-2A, or H-2B visa. It further amends 49 U.S.C. 31310 to establish a lifetime disqualification from operating a CMV for individuals lacking such status, except for certain B visa holders or those with valid ESTA admission records. To avoid withholding of all federal funding provided to the state or for projects therein, it requires states to recertify all existing CDL holders within 180 days of enactment—including verification of eligible status, English proficiency per 49 C.F.R. 391.11(b)(2), and passage of knowledge and skills tests in English—and to revoke noncompliant licenses.
