S. 3922 — Traditional Cigar Manufacturing and Small Business Jobs Preservation Act of 2026

This section establishes a limitation of FDA authority over traditional large and premium cigars (i.e., any roll of tobacco wrapped and bunched with 100% leaf tobacco, containing no filter, tip, or non-tobacco mouthpiece, weighing at least 6 pounds per 1,000 count, meeting specified hand-rolling or machine criteria, and excluding cigarettes or little cigars) by exempting them from provisions of the Federal Food, Drug, and Cosmetic Act regulating tobacco products, except for section 907(d)(3). It revises the heading of the existing limitation on authority for tobacco leaf to read "Limitation of authority for certain tobacco leaf" and includes a rule of construction prohibiting FDA regulations on matters involving these cigars. This section also makes conforming amendments to tobacco product user fee provisions to exclude traditional large and premium cigars.
