S. 393 — Banning SPR Oil Exports to Foreign Adversaries Act

This section prohibits the Secretary of Energy from exporting or selling petroleum products drawn down from the Strategic Petroleum Reserve (SPR)—a stockpile of crude oil and petroleum products maintained for emergency supply disruptions—to the People's Republic of China, Democratic People's Republic of Korea, Russian Federation, Islamic Republic of Iran, or any entity owned or controlled by those countries or the Chinese Communist Party. The Secretary may waive the prohibition upon certifying that an export or sale is in the national security interests of the United States and must issue an implementing rule within 60 days of enactment. This section also makes conforming amendments to (1) reference the prohibition in SPR drawdown and sale authorities, (2) update the EPCA table of contents, and (3) except the prohibition from the general policy against federal restrictions on crude oil exports (42 U.S.C. 6212a(b)).
