S. 3932 — Private Detention Accountability Act

This section requires the Director of U.S. Immigration and Customs Enforcement to submit to four congressional committees—(1) the Senate Committee on Homeland Security and Governmental Affairs, (2) the Senate Committee on the Judiciary, (3) the House Committee on Homeland Security, and (4) the House Committee on the Judiciary—a report on the results of each audit of a detention facility conducted by the Department of Homeland Security's Office of Detention Oversight, along with actions taken to remediate any deficiencies, not later than 30 days after the audit's completion.

This section prohibits U.S. Immigration and Customs Enforcement from housing new aliens at specified detention facilities unless the Office of Detention Oversight has (1) completed an audit of the facility, (2) remediated any deficiencies identified in the audit, and (3) submitted the report required under section 1. The restriction applies to facilities commencing operations on or after the date of enactment and to facilities operating before enactment that have undergone such an audit.
