S. 3955 — Migrant Crime Reporting Act of 2026

This section defines terms for purposes of the Act, including: (1) eligible State, as a state that requests a migrant crime reporting grant for a fiscal year and, for the prior fiscal year, publicly posts on its website and submits to the Secretary of Homeland Security (DHS) a migrant crime report; (2) migrant, as a person unable to present a valid U.S. Permanent Resident Card (Form I-551), official U.S. birth certificate, unexpired U.S. passport, Certificate of Citizenship (Form N-560 or N-561), or Certificate of Naturalization (Form N-550, N-570, or N-578); (3) migrant crime report, as a report on the number of migrants charged with or convicted of a criminal offense in a state during a fiscal year; (4) migrant crime reporting grant, as a grant awarded under section 3(a); and (5) State, as each of the several states of the United States.

This section establishes migrant crime reporting grants under which the Secretary awards $1,000,000 to each eligible state for FY2027 and each fiscal year thereafter, subject to the availability of appropriations. Grant funds must be used to collect and analyze data from state law enforcement agencies on the number of migrants charged with or convicted of a criminal offense, and recipient states must publicly post and submit to the Secretary an annual migrant crime report on a state-operated website.

This section includes funding for migrant crime reporting grants—specifically, awarding grants under the Migrant Crime Reporting Act of 2026—by adding a new paragraph (13) to the funding list in Section 100051 of the One Big Beautiful Bill Act (P.L. 119-21).
