This section revises the formula for calculating each state's share of combined apportionments from the Highway Trust Fund for core federal-aid highway programs—including the national highway performance program, surface transportation block grant program, highway safety improvement program, congestion mitigation and air quality improvement program, national highway freight program, carbon reduction program, PROTECT program planning and integration activities, and metropolitan planning—for FY2027 and each fiscal year thereafter (striking the prior subsection (c)). (1) Initial amount.—The initial amount for each state equals the total amount available for apportionment multiplied by the state's proportionate share of all states' FY2012 apportionments for such programs. (2) Minimum guarantee adjustment.—Initial amounts are adjusted upward as needed to ensure no state receives less than 95% of its applicable percentage (i.e., the state's estimated highway-user contributions to the Highway Trust Fund, excluding the Mass Transit Account, for the most recent fiscal year with available data, divided by national totals) multiplied by the total amount available. On October 1 of each fiscal year, the Secretary apportions amounts authorized for the listed programs in accordance with these calculations. (Thus, this bases shares primarily on FY2012 proportions while providing a 95% return on estimated contributions, potentially benefiting donor states more than prior formulas.)
