S. 4019 — Diego Garcia Treaty Oversight Act

This section defines, for purposes of this Act, (1) "appropriate committees of Congress" as the Senate Committees on Foreign Relations, Armed Services, and Appropriations; and (2) "covered agreement" as the exchange of notes dated December 30, 1966, concerning the availability for defense purposes of the British Indian Ocean Territory.

This section requires Senate advice and consent for any modification to the covered agreement concerning the British Indian Ocean Territory and prohibits the obligation or expenditure of federal funds by any federal department or agency to implement such a modification absent Senate consent. It further directs the President, prior to entering into any negotiations on a modification, to submit to the appropriate congressional committees a classified and unclassified report detailing (1) the national security rationale for the proposed modification, (2) implications for U.S. operational control of Diego Garcia, and (3) risks posed by third-party sovereign claims or foreign military presence.
