S. 4033 — Critical Minerals Investment Tax Modernization Act of 2026

This section increases the percentage depletion rate to 22% (from 14%) for rare earths (i.e., the 15 lanthanide elements) and scandium by adding them to the list of qualifying minerals under IRC §613(b)(1)(B). The change applies to taxable years beginning after the date of enactment.
