S. 4035 — DEATH BETS Act

This section prohibits registered entities under the Commodity Exchange Act from listing for trading or accepting for clearing (1) any agreement, contract, transaction, or swap based on an excluded commodity (as defined in CEA Section 1a(19)(iv), i.e., certain event-based contingencies beyond parties' control) that involves, relates to, or references terrorism, assassination, war, or similar activities as determined by the Commodity Futures Trading Commission; or (2) any such contract that involves, relates to, or references an individual's death or correlates closely to an individual's death. (Thus, this bars exchange-traded "event contracts" or betting markets on wars, terrorist acts, assassinations, or deaths.)
